When an officer breaks the law while conducting their work, they should be held accountable. That’s why I support independent investigations into police misconduct, especially when departments are unable, or unwilling to do so themselves. I urge you to pass House Bill 1445 without any amendments that water it down.

Amendments 825 and 823 undermine the ability of the Attorney General’s office to address constitutional and state law violations at law enforcement agencies. In the past decade, the AG’s office has only brought one of these kinds of cases. This bill would not lead to a flood of cases – this is clear from the half-dozen states that have already passed similar bills.

Amendment 825 is unworkable – it requires the AG to prove its pattern or practice case before investigating it.

Amendment 823 is a poison pill that kills the bill. In practice it makes even doing an initial investigation of wrongdoing an impossible task.

Ultimately, we all expect police departments and sheriff offices to follow the law and constitution – and most do. HB 1445 provides safeguards for the outliers, where there is a department that is unable – or unwilling – to uphold this duty. Please vote no on amendments 823 & 825 and pass a clean bill of HB 1445!
